The petitioner seeks regular bail in connection with Excise Case No. 290C2 of 2018, registered for the offence punishable under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2018 / Bihar Prohibition and Excise Act, 2016.

The allegation is regarding raid having been committed by the police in village Murarpur, whereafter, on search, 50 liter country made wine, as also 80 kg. Java gur and various apparatus were recovered and the petitioner was caught from the spot.

No.76556 of 2018(2) dt.11-01-2019 2/2 The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case inasmuch as the premises from where the alleged recovery is stated to be made, does not belong to the petitioner and the petitioner is having a clean antecedent. It is further submitted that the petitioner is languishing in custody since 04.11.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Sheikhpura in connection with Excise Case No. 85 of 2018-19.
