Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 14.09.2015 in connection with Jakkanpur P.S. Case No. 110 of 2015 for the offences instituted under Sections 420 and 379 of the IPC. The prosecution story, in brief, is that the informant's company has got an agreement to deposit the cash amount and maintenance of ATM among other Banks, NCR(P) Limited also manages the concerned State Bank, ATM situated at Janaki Sadan, Bengali Tola, Mithapur(New Bus Stand), Patna, Bihar-4, bearing ATM No. GFBU014388275. In which on 17.03.2015, one Pramod

Patna High Court Cr.Misc. No.26441 of 2016 (3) dt.30-08-2016 2/2 Kumar, Senior Manager (ATM), verified the differences found in the NCR/MS report. Thereafter, on 18.03.2016, it has been found loss of Rs. 7,52,000/-. It has been also alleged that from EJ report, it has been found that on 06.03.2015, in the ATM, Rs. 7,52,000/- has been stolen by some unknown persons. Hence, the F.I.R. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.09.2015 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He is not named in the F.I.R. He has been made accused in the present case on the basis of a confessional statement of co-accused. The other co-accused have been granted bail by this Court vide Cr. Misc. Nos. 26013 of 2016 and 28072 of 2016.

On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.
