The petitioners seek bail in a case instituted for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act.

It is alleged that total 15.6 liters of country made liquor has been recovered from hotel of the petitioner no.1. The seizure list is on record bearing signature of Mahesh Kumar Das, petitioner no.2.

It has been submitted on behalf of the petitioners that petitioner no.1 is lady. The seizure list does not bear her signature. It has further been submitted that aforesaid Mahesh Kumar Das is an employee of petitioner no.1. He has no concern

Patna High Court Cr.Misc. No.54937 of 2016 (2) dt.21-12-2016 2/2 with any sale and purchase of the said liquor. They are in custody since 03.12.2016.

In the aforesaid circumstances and keeping in view the period already spent by the petitioners in custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 553 of 2016.
