2. Petitioners apprehend their arrest in a case registered for the offence punishable under section 366 of the Indian Penal Code .

3. Allegation against these petitioners is that they along with other co-accused persons kidnapped the sister of the informant.

4. It is submitted on behalf of the petitioners that these petitioners have falsely been implicated in this case merely because they happen to be family member of co-accused Rambilas Kumar. It is the specific case of the prosecution that

Patna High Court CR. MISC. No.24902 of 2024(3) dt.15-05-2024 2/2 co-accused Rambilas Kumar has kidnapped the sister of the informant and these petitioners have got no concern with the same. Moreover, it appears that there was love affair between the victim and co-accused Rambilas Kumar, and so far as, these petitioners are concerned, no case is made out against them under Section 366 of IPC.

5. Learned counsel for the State oppose the bail petition.

6 Considering the fact that specific allegation of kidnapping the sister of informant is against co-accused Rambilas Kumar and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai in connection with Kiul P.S. Case No. 99 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
