2. The petitioner apprehends his arrest in connection with Dalsingsarai P.S. Case No. 402 of 2024, registered for the offences punishable under Sections 140(1), 140(3), 352, 3(5) of the BNS, 2023.
3. As per allegation, the accused persons including the petitioner kidnapped the son of the informant.
4. The learned counsel for the petitioner has submitted that the victim was recovered. He has further submitted that in his statement recorded under Section 183 of the BNSS, he did not support the prosecution case.
5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that he has filed a counter affidavit. In his statement recorded under Section 183 of the BNSS,
Patna High Court CR. MISC. No.21758 of 2025(4) dt.24-09-2025 2/2 the victim has stated that there was some hot exchange of words between the mother of the victim and his wife and that is why, he left his house.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 402 of 2024, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023.
