The petitioner apprehends his arrest in connection with Tr. No.4727 of 2018 arising out of Complaint Case No.1495 of 2017 registered under Section 498A of the Indian Penal Code.

The petitioner is the husband and petitioner is ready to keep his wife.

Learned counsel for the informant-wife submits that wife is willing to live with her husband, if her husband keeps her properly.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the

Patna High Court Cr.Misc. No.74670 of 2018(2) dt.20-12-2018 2/2 court below within a period of four weeks from the date of receipt of the order, be released on provisional bail for six months on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Abhishek Kumar, J.M. Ist Class, Bettiah in connection with Tr. No.4727 of 2018(arising out of Complaint Case No.1495 of 2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

Thereafter, the court below shall make all efforts for resolution of the disputes between husband and wife. When the dispute between husband and wife resolves and the petitioner keeps his wife properly, learned court below shall confirm the provisional bail granted to the petitioner immediately thereafter. If the disputes between husband and wife does not resolve, learned court below shall pass order in accordance with law on the provisional bail of the petitioner.
