JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 302 of the Indian Penal Code and 27 of the Arms Act. Allegation is that some unknown persons have shot dead father of informant. Petitioner has been made accused on the basis of suspicion.

It has been submitted on behalf of petitioner that he is in custody since 8.7.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been made accused merely on the basis of suspicion. Subsequently, in course of investigation the daughter of the deceased has claimed that she had seen four persons fleeing away from the place of occurrence and petitioner was also one of them. Except for this, there is no eye witness to the alleged occurrence. Other accused person has been granted bail vide Cr. Misc. no. 52805 of 2015.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.45743 of 2016 (3) dt.25-11-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VI, Gaya , in connection with Tekari P.S. Case no. 212 of 2014.
