JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-07-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends her arrest in connection with Khagaul P.S. Case No. 186 of 2016 for the offences punishable under sections 406, 420 and 34 of the I.P.C.

Allegedly, the informant has given money to the different persons. The petitioner was given Rs. 24,000/- but the money has not been returned by the petitioner to the informant. Submission is of false implication and that whatever money has been taken the same has been returned, the informant has filed this false case only with a view to harass the accused

Patna High Court Cr.Misc. No.22696 of 2017 (4) dt.13-07-2017 2/2 persons including the petitioner, the stamp paper was not returned by the informant, co-accused Madhumita Choudhary has been allowed pre-arrest bail vide Cr. Misc. No. 19120 of 2017, no criminal offence is made out and at best it can be a civil dispute, money can be realized by filing the money suit and not by this case.

The learned A.P.P. fairly submits that the co-accused Madhumita Choudhary has been allowed pre-arrest bail vide Cr. Misc. No. 19120 of 2017 by the co-ordinate Bench of this Court. In the facts and circumstances as stated above, the petitioner, in case of her arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Danapur in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
