JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 This application, for grant of anticipatory bail, arises out of Nasiriganj P.S. Case No. 177 of 2018, disclosing offences under Section 414 of the Indian Penal Code.

Allegation is of recovery of one commercial Mahindra Pick-up vehicle from the house of the petitioner and on demand, the petitioner showed the forged papers of the vehicle.

Submission of learned counsel for the petitioners is that initially the vehicle in question belonged to one Kamlesh, which was subsequently purchased by one Sanjay and from Sanjay, the petitioner has purchased the said vehicle, which is evident from Annexure -3 of the petition and the process of registration of vehicle in the name of petitioner is pending before the concerned District Transport Officer. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Bikramganj (Rohtas), in connection with Nasiriganj P.S. Case No. 177 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is made clear that the petitioner has to furnish the document showing the registration of vehicle in his name before the court below within a period of three months and if the petitioner fails to furnish the said document, his bail bonds would automatically stand cancelled.
