Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 27.7.2017 passed in Cr. Misc. No.29126 of 2017. Petitioner happens to be husband and the case is of dowry death.

Submission of the learned counsel for the petitioner is that in this case up till now two witnesses have been examined, petitioner was residing at Dubai and the death is due to hanging. Further submission is that the petitioner is in custody since 9.2.2017 i.e. for more than 28 months. . Heard learned A.P.P. also.

Having heard both sides and considering the fact that the petitioner is in custody for more than 28 months, let the petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court CR. MISC. No.23565 of 2019(3) dt.26-06-2019 2/2 bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District Judge IV, Siwan in connection with Siwan Muffasil P.S.Case No.36 of 2017, with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid direction, this application is allowed.
