====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 26-04-2023 Heard Mr. Pankaj Kumar Sinha, learned counsel appearing on behalf of the petitioner and Mr. Surendra Prasad Singh, learned A.P.P. for the State.
2. The petitioner seeks regular bail in connection with Barhat P.S. Case No. 13 of 2021 (G.R. No. 170/2021) for the offence punishable under Sections 147, 148, 121, 121(A) and 120(B)/149 of the Indian Penal Code, Sections 25(1-B)a, 26 and 35 of the Arms Act, Sections 16, 17, 18, 19 and 20 of the Unlawful Activities (Prevention) Act and Sections 4 and 5 of the Explosive Substance Act.

Prosecution story, in brief, is that on secret information, a raid was conducted by the police in Chormora forest and one co-accused Prakash Rana was apprehended by the police who disclosed the name of the petitioner as his accomplice. From the forest area, arms, ammunition, explosive substances and other incriminating materials were recovered.

4. Learned counsel appearing on behalf of the petitioner informs this Court that the petitioner was released on bail vide order dated 22.08.2022 passed in Cr. Misc. No. 64673 of 2021, however the petitioner could not be released as the criminal antecedent as mentioned in Para-3 of the said bail application was found to be incorrect and bail bond of the petitioner was not accepted by the court below. The petitioner, thereafter, again moved before the court below for grant of regular bail and the same was also rejected vide order dated 14.06.2021. The petitioner has again come before this Court for regular bail.

Considering the fact that this Court had already exercised its mind and granted bail to the petitioner and for the reason that only one criminal antecedent could not be stated in Para-3 of the said bail application, bail bond was not accepted, petitioner, above named, is directed to be enlarged on bail on similar terms and conditions as contained in order dated 22.08.2022.
6. Accordingly, the bail application stands disposed of.
