====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 22-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Arwal P.S. Case No. 171 of 2018, instituted for the offence under Section(s) 392 and 411 of the Indian Penal Code.

It is alleged in the written report that petitioner along with other accused persons on the point of revolver and knife robbed the informant and took Rs.40,000/- while the informant along with his son was returning after withdrawing money from the State Bank of India, Arwal Branch, for medical purpose through cheque from his account. Police apprehended the petitioner but other co-accused managed to run away. It is further alleged that Rs.31,000/- has been recovered from

Patna High Court Cr.Misc. No.76483 of 2018(2) dt.22-01-2019 2/2 possession of the petitioner.

Counsel for the petitioner submits that petitioner is in custody since 13.6.2018 having clean antecedent. He further submits that compromise has already taken place between the parties. There is no identifying mark of the notes which could show that they were stolen article.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Arwal P.S. Case No. 171 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
