2. The petitioner apprehends arrest in connection with Darauli P.S. Case No. 133 of 2016 dated 23.09.2016 instituted under Sections 147/341/323/324/307/504 of the Indian Penal Code.
3. The allegation against the petitioner and four others is of general assault and specifically against the petitioner of having inflicted knife blow on the aunt of the informant.
4. Learned counsel for the petitioner submitted that there is a case and counter case and there is dispute relating to land pending between the parties. It was further submitted that there have been injuries on both the sides. Learned counsel submitted that there is no detail given in the fardbeyan as to on which part of the
Patna High Court Cr.Misc. No.23438 of 2017 dt.11-07-2017 2/2 body the petitioner inflicted the knife blow.
5. Learned A.P.P. submitted that there being a specific allegation of inflicting knife blow against the petitioner which is corroborated by the injury report, it is not required that the fardbeyan should contain details as it is only during trial that the same shall come.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on anticipatory bail.
