Petitioner seeks bail in a case registered for the offences punishable under Sections 30, 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

It appears that similarly situated co-accused Raushan Kumar Gupta @ Munna Shah @ Raushan Kumar has already been allowed bail by a Co-Ordinate Bench of this court vide order dated 11.02.2019 in Cr. Misc. No. 7619 of 2019 at Annexure-2. Petitioner is in custody since 07.02.2019. Submission is that though, the petitioner has got nine cases registered for the offences under the Excise Act, however, in none of the cases anything was recovered from possession of the petitioner. Petitioner is victim of police atrocity. Considering the aforesaid facts, let the petitioner,

Patna High Court CR. MISC. No.23752 of 2019(2) dt.15-04-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dariyapur Police Station Case No. 08 of 2019, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
