In this case, the petitioner is apprehending her arrest in connection with Tajpur (Halai O.P.) P.S. Case No. 12 of 2017 registered for offences under sections 272/273 of the Indian Penal Code and Section 30(A)/36 of the Bihar Excise Act, 2016. As per allegation, on the basis of confidential information, the police have entered into the house of Kanhaiya Sahni from where five liters liquid was found kept in the corner of the room, it has been claimed that the same was liquor. Kanhaiya Sahni was arrested but, an allegation has been made that the petitioner fled away from there. There is no allegation against the petitioner that she has either concealed or objected in any manner
Patna High Court Cr.Misc. No.23471 of 2017 (2) dt.11-07-2017 or had kept liquor in the house.
Looking to the entire facts and circumstances of the case, let the petitioner, namely, Krishna Devi, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Samastipur in connection with Tajpur (Halai O.P.) P.S. Case No. 12 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
