The petitioner seeks regular bail in connection with Bhabua P.S. Case No. 654 of 2017 registered for the offence punishable under Sections 386/34 of the Indian Penal Code. The allegation is regarding demanding ransom from the informant by the co-accused persons, namely, Vikash Yadav and Munna Yadav. The name of the petitioner is stated to have transpired on account of the confessional statement made by the said co-accused Munna Yadav.
The learned counsel for the petitioner submits that the petitioner had withdrawn the earlier bail petition with liberty to move this Court after six months' custody and the antecedent of the petitioner was not good since three other cases are
Patna High Court Cr.Misc. No.76838 of 2018(3) dt.23-01-2019 2/2 pending against the petitioner, however, the petitioner is on bail in the said three cases. It is further submitted that the said coaccused person, namely, Vikash Yadav has already been granted bail, hence the petitioner is also fit to be granted the privilege of regular bail. The petitioner is stated to be in custody since 18.11.2017.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhabua in connection with Bhabua P.S. Case No. 654 of 2017.
