The petitioners seek anticipatory bail in Sirdala P.S. Case No.22 of 2017 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2017. It has been alleged that on information the police has raided the place of occurrence and found that petitioners and others were engaged in trade of illegal liquor. After seeing the police petitioner fled away. There was recovery of 10 liters of illegal liquor.
In such view of the matter, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioners surrender
Patna High Court Cr.Misc. No.23457 of 2017 (2) dt.10-07-2017 before the court below within a period of three weeks, the court below will pass an order on the same day taking into consideration the quantity of liquor without being prejudiced by the order passed by this Court.
