2. The petitioner seeks bail in a case registered for offence under Sections 363, 365 of the Indian Penal Code and later on, Section 302/201 of the Indian Penal Code was added.
3. F.I.R. has been registered against unknown for kidnapping and thereafter, committing murder of son of informant.
4. It is submitted on behalf of petitioner that name of petitioner transpired during course of investigation on the basis of confessional statement of co-accused Amarnath Kumar. The only material, which has come against petitioner, is that he assisted other co-accused persons in commission of such
Patna High Court CR. MISC. No.25165 of 2024(3) dt.17-05-2024 2/2 offence. No one has claimed to have seen the actual occurrence. Petitioner has got clean antecedent and is in custody since 28.11.2023. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Masaurhi, District - Patna in connection with Dhanarua P.S. Case No. 641 of 2023.
