The petitioner seeks bail in connection with Motipur P.S. case no. 172 of 2016, registered under Sections 25 (1-B)a, 26(ii)/35 of the Arms Act and Sections 399, 402, 414 and 120 B of the IPC.

On a tip off the informant is said to have raided one line hotel wherefrom some persons tried to escape. However, 08 persons were arrested. The petitioner being one of them. It is alleged that from his possession one country made pistol and one live cartridge from his pocket was recovered. It is stated that the petitioner has clean antecedents and is languishing in custody since 15.06.2016.

In view of the above facts, this Court is inclined to

Patna High Court Cr.Misc. No.48692 of 2016 (2) dt.26-11-2016 2/2 extend the privilege of bail to the petitioner. Let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM Muzaffarpur, in connection with Motipur P.S. case no. 172 of 2016, subject to the following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial Court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive dates, the trial Court shall have liberty to cancel the bail bond of the petitioner and secure his arrest in accordance with law.
