JUSTICE SUDHIR SINGH ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 399 and 402 of the Indian Penal Code and Sections 25(1B) A, 26 and 35 of the Arms Act. Allegation against petitioner is that he was apprehended along with two other persons while they were making a plan to commit dacoity and from possession of petitioner one loaded country made pistol was recovered.

It has been submitted on behalf of petitioner that he is in custody since 14.7.2016. Chargesheet has been submitted against petitioner. There is no allegation of tampering of witnesses against petitioner. From possession of petitioner one loaded country made pistol has been recovered. No compliance under Section 100 of the Code of Criminal Procedure is made. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
