The petitioner seeks regular bail in connection with Khaira Police Station Case No. 385 of 2019, registered for the offences punishable under Sections 25 (1-b)a/26 of the Arms Act.

The allegation against the petitioner, as per the First Information Report lodged by the Station House Officer of Khaira Police Station, is that during the investigation of Khaira Police Station Case No. 370 of 2019, registered for the offence punishable under Section 392/34 of the Indian Penal Code, the name of the petitioner was disclosed by the accused persons therein and on the basis of confessional statement, the police

Patna High Court CR. MISC. No.23637 of 2020(2) dt.16-09-2020 2/2 raided the house of the petitioner and recovered one live cartridge from the left pocket of the pant of the petitioner and also one loaded country-made pistol, which was being kept below his bed.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case on the basis of confessional statement of co-accused in another case. He further submits that the petitioner has been arrested in this case and was remanded in Khaira Police Station Case No. 370 of 2019. He further submits that the petitioner is in custody since 25.12.2019.

Having heard learned Counsel for the parties and taking into consideration the materials on record, I am not inclined to grant regular bail to the petitioner, at this stage. This application is, accordingly, dismissed.

However, the petitioner may renew his prayer for bail after six months from today, if the trial does not show any progress.
