JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The accusation against the petitioner is that he was entrusted to withdraw Rs. 3 lacs from the Bank but he not only withdrew the aforesaid amount but fled away with the said amount.

Para-70 of the case diary goes to show that petitioner was summoned by the investigating officer under section 41(1) of the Cr.P.C and, subsequently, he was released on bail after execution of bail bonds.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with

Patna High Court Cr.Misc. No.47173 of 2016 (3) dt.08-12-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Mojahiddpur P.S.Case No. 113 of 2016.
