JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of a writ in the nature of mandamus for granting of 1st ACP and 2nd & 3rd MACP on and from 04.04.1992 till date and promotion on and from 04.04.1992 and also for grant of consequential arrears by way of granting 1st ACP and thereafter 2nd and 3rd MACP on and from 04.04.1992 and further for an appropriate direction/ order / command directing the respondents to quash all these orders and also for any other relief/ reliefs the petitioner may found entitled."

At the outset, the learned counsel for the petitioner submits that the petitioner is confining his relief to grant of the benefits of 1st ACP, considering the date of absorption i.e. 10.02.2006 as the date of fresh appointment, hence the Respondents be directed to pass appropriate orders accordingly, with regard to the same. It is directed accordingly. 3.

It is needless to state that the Director, Primary Education, Education Department, Government of Bihar, Patna, shall pass a reasoned and a speaking order with regard to the aforesaid claim of the petitioner regarding grant of the benefits of 1st ACP, within a period of four weeks of receipt / production of a copy of this order.
