ANJANA MISHRA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 18.07.2016 in connection with Case No. C-I 220 of 2016 registered for the offences punishable under Sections 47(a) and F of the Excise Act. Counsel for the petitioner submits that though it is alleged that the recoveries were made from his house but actually they were recovered from the backyard of the house and not from the conscious possession of the petitioner.

Considering the entire facts and circumstances of the case and that the petitioner has no criminal antecedent, let the above named petitioner, be released on bail on furnishing bail
