Prayer in this application is for grant of bail in Kotwali P.S. Case No. 188 of 2016 registered under sections 379/411 IPC. The petitioner along with the co-accused Rakesh Kumar are named in the FIR alleging that on the previous night both of them had come and slept near the house of the informant. In the night they committed theft of a motorcycle parked outside. The contention of the petitioner is that co-accused Rakesh Kumar has since been released on bail, vide order dated 17.09.2016 (Annexure-2). The petitioner is in custody since 05.05.2016.

No.49404 of 2016 (2) dt.09-12-2016 2/2 In the circumstance, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Bhagalpur in Kotwali P.S. Case No. 188 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law.
