The petitioner is accused in connection with Complaint Case No. 89C of 2016, registered under Sections 498A, 323 and 504 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
The accusation is of torturing the complainant by her husband and in-laws due to non-fulfillment of demand of dowry and removing her along with her child forcibly from matrimonial house.
Learned counsel for the petitioner submits that petitioner is the husband of the complainant-opposite party no. 2
Patna High Court Cr.Misc. No.71218 of 2018(2) dt.03-12-2018 2/2 and he has falsely been implicated in this case due to petty dispute. It is further submitted that petitioner is in custody since 04.09.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Supaul, in connection with Complaint Case No. 89C of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
