02. 05.10.2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. It is contended on behalf of the petitioner that he has misused the privilege of bail for which he is in custody since 30.06.2016. It is further contended that the bail of three other persons were also cancelled who have already been granted bail by court below. The petitioner undertakes to remain present on each and every date during the course of trial in the court below. Having regard to the facts and circumstances of the case, the petitioner, namely, Ram Gulam Paswan is directed to

Patna High Court Cr.Misc. No.42688 of 2016 (2) dt.05-10-2016 be released on bail on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Nawada in connection with Complaint Case No. 664 of 2000 subject to the condition that the petitioner shall remain present on each and every date during the course of the trial in the court below. If the petitioner fails to remain present on two consecutive dates during the course of the trial without any reasonable cause being shown, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
