Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Kusheshwar Asthan P.S. Case No. 01 of 2021 for the offence punishable under Sections 406, 409, 420, 477(A)/34 of the Indian Penal Code.

The Senior Superintendent of Police, Darbhanga has joined the proceeding virtually and he has assisted the Court on the facts of the case.

It is the prosecution case that a large number of non-existent persons who could not have been beneficiaries of

No.31966 of 2021(4) dt.25-03-2022 2/2 the Government scheme have been distributed the fund illegally and the petitioner being Data Entry Operator has manipulated the list supplied by the officials and has not produced the original list given to him for data entry which indicates that the petitioner is also involved in the case.

Considering the fact that the petitioner is involved in misappropriation of Government fund and he is the person who has finalized the list and made entry in the computer, in the opinion of this Court, this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, this anticipatory bail application is dismissed.

The petitioner is directed to surrender in the Court below within a period of four weeks from today. If the petitioner does not surrender in the Court below within aforesaid period of four weeks, in such circumstance, the Senior Superintendent of Police, Darbhanga, shall be free to take all coercive steps for arresting the petitioner.

The personal appearance of Senior Superintendent of Police, Darbhanga, is dispensed with.
