The petitioner is accused in connection with Barbigha P.S. Case No. 255 of 2016 (G.R. No. 771 of 2016) registered under sections 406 of the I.P.C. and 138 of N.I. Act pending in the Court of A.C.J.M.-II, Sheikhpura.
This is a case of dishonour of cheque as also threat given by the petitioner.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. It is also submitted that petitioner is in custody since 26.10.2016.
Learned A.P.P. appearing on behalf of the State opposes the prayer of the petitioner with submission that petitioner
Patna High Court Cr.Misc. No.54865 of 2016 (4) dt.28-01-2017 2/2 is named in the F.I.R. and charge has already been framed in this case.
Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected. However, petitioner may renew his prayer for bail after framing of charge.
