This application for anticipatory bail arises out of Pasraha P.S. Case N0. 90 of 2016, disclosing offences under Sections 420 and 406 of the Indian Penal Code. The allegations are made in the First Information Report that the petitioners had entered into the house of the informant and started abusing the informant's son and torn her sari. They are said to have taken away some cash, golden ring and threatened her not to lodge the case. Learned counsel appearing on behalf of the petitioners has submitted that there is no specific role attributed to these petitioners in the First Information Report. He has submitted that because of certain local dispute, the petitioners have been implicated. He has also submitted that

there is no chance that these petitioners were fleeing away from the course of investigation or trial, if granted anticipatory bail.

Considering the above submissions, this application is allowed. Let the petitioners above named in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Khagaria in Pasraha P.S. Case No. 90 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
