JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-10-2022 The present writ petition has been filed seeking the following reliefs:- "I. For issuance of a writ in the nature of Mandamus commanding and directing to the respondents to initiate an encroachment proceeding under the Bihar Public Land Encroachment Act against the persons who have encroach the Government land/ public road situated under Mauza Dhapahar Patti Hardiya, Revenue Thana No. 197, Khesra No. 341,342,343,433 and Mauza Kudarkat, Thana No. 180, Khesra No. 1543 comes under the jurisdiction of circle office, Chauradano, East Champaran.

II. For issuance of a writ in the nature of Mandamus commanding and directing the respondents to conclude the encroachment proceedings under the Bihar Public Land Encroachment Act earliest as possible earlier and

Patna High Court CWJC No.10186 of 2021(2) dt.13-10-2022 2/2 remove the encroachment from the Government land/public road situated under Mauza Dhapahar Patti Hardiya, Revenue Thana No. 197, Khesra No. 341, 342, 343, 433 and Mauza Kudarkat, Thana No. 180, Khesra No. 1543 comes under the jurisdiction of circle office Chauradano, East Champaran." At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Chauradano, District- East Champaran, for redressal of his aforesaid grievance.

Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Chauradano, District- East Champaran, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith. The writ petition stands disposed off on the aforesaid terms.
