====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 05.03.2019 in a case for the offence registered under Sections 341, 323, 354(B)/34 of the IPC and 12 of POCSO Act, 2012. The prosecution story, in brief, is that on 05.12.2018 while the informant Manisha Kumari aged about 16 years, coming from her house after giving examination then at 2.00 P.M. in the day, on the way, the petitioner and co-accused Nitish Kumar who were sitting on road, forcibly caught her hands and started pulling her. She cried then one boy of Darahpur came there and saved her.

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.21970 of 2019(2) dt.08-05-2019 2/2 Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case for oblique reason. There is enmity between the parties. There is no substantive evidence to suggest the implication of the petitioner in the present case. Other coaccused has been granted bail by another Co-ordinate Bench of the Court vide Cr. Misc. No. 11333 of 2019 order dated 25.02.2019.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge Ist-cum-Special Judge, POCSO, Buxar, in connection with POCSO Case No. 63 of 2018, arising out of Buxar (Industrial) P.S.
