JUSTICE ALOK KUMAR PANDEY ORAL ORDER 24-04-2025 In the instant petition, petitioner has prayed for the following relief:- To provide the adequate police security/protection to the officials involved in the measurement of the lands of the petitioner as well as to the petitioner so that the lands of the petitioner may be measured accordingly and after measurement of the lands, boundaries may be constructed under the protection of proper police force.
(ii) To direct the respondents to give the effect of order dated 24.08:2024 issued vide memo No. 1471, 24.08.2024 issued vide memo No. 1472 and order dated 12.09.2024 issued vide
2/4 memo No. 1593 by which there are directions of the Respondent No.6 to measure the lands of the petitioner situated under Mauza Tarwan Thana No. 251 Siwan Sadar bearingKhata No.

Learned counsel for the petitioner has submitted online application for measurement of the land in question on 27.07.2024 in Case No. 60/2024-25, 03.08.2024 in Case No. 64/2024-25 and 12.09.2024 in Case No. 80/2-24-25 by making the payments of Rs. 3000/-, Rs. 30000/- and Rs. 1000/- respectively and in the light of application, direction was given to measure the land of the petitioner. It has been submitted that due to obstruction or nuisance created by about 30 unknown persons the measurement of the land has not been completed. He further submits that he has represented his grievance before respondent no. 6, the
3/4 Circle Officer, Siwan, which is annexed at P/7. Further, petitioner has represented his grievance before SDO, Siwan which is mentioned at annexure P/8 and he has also given representation before the District Magistrate, Siwan but they have not taken any action on the said grievance. Learned counsel for the petitioner has submitted that petitioner is widow lady and she is helpless. 3.Learned counsel on behalf of the State has submitted that in case petitioner files fresh representation before the concerned authority, they shall look into the matter and pass appropriate order.

Considering the facts and circumstances of the case and the arguments advanced on behalf of both the parties, the present writ petition is disposed of with liberty to the petitioner to approach the authority concerned by filing fresh representation for redressal of his grievance, which has been raised by the petitioner in the present writ petition, within a period of four weeks from the date of receipt of a copy of this order. The concerned authority is directed to consider and dispose of the grievance of the petitioner, expeditiously, preferably within a period of three
4/4 months from the date of filing of representation/application by the petitioner, as per law.
