JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-04-2015 Heard counsel for the petitioner and the State. The petitioner is the husband and is facing accusation punishable under section 304-B IPC.

Within one year of marriage the deceased was done to death in her matrimonial home in suspicious circumstances. The contention of the petitioner is that due to profuse bleeding the victim died and cremation was done. At least there is some evidence that she was afforded medical treatment. Learned APP, on the other hand, opposed the prayer and submitted that other witnesses have supported the prosecution case as reflected from the impugned order.

Considering the facts and circumstances of the case, I

Patna High Court Cr.Misc. No.42686 of 2014 (2) dt.21-04-2015 2 / 2 am not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for bail is rejected.

The petitioner should surrender in the court below and pray for regular bail which shall be considered and disposed of on its own merit without being prejudiced by the present order. (Kishore Kumar Mandal, J) HR/- U
