The petitioner is a license holder under the Public Distribution System (Control) Order, 2001 as enforced in the State of Bihar vide Bihar Fair Price Shop Order, 2007 (hereinafter referred to as the 'Control Order') bearing License No. 23030117 / 2008.

The license of the petitioner stands cancelled under the orders of the licensing authority-cum-Sub Divisional Officer, West Muzaffarpur vide order bearing Memo No. 1212 dated 27.10.2011 placed at Annexure-12.

The order of cancellation is appealable under Section 15 of 'Control Order' and records manifest that the petitioner has

Patna High Court CWJC No.717 of 2014 (2) dt.21-04-2015 approached this Court without exhausting the alternative remedy of appeal.

In the circumstances, this writ petition is disposed of with liberty to the petitioner to exhaust the remedy of appeal and any such appeal filed within two weeks from today would be considered by the appellate authority and disposed of in accordance with law.
