Petitioner seeks bail in a case registered for the offences punishable under Section 47(a) (e) of Bihar Excise (Amendment) Act, 2016.

15 litre mahua liquor and other apparatus which are used in preparation of country made liquor are said to have been recovered from an orchard. Petitioner was caught by the police on the spot but submission on behalf of the petitioner is that petitioner does not have any concern with the seized liquor and as a matter of fact, he was caught by the police officials on mere suspicion. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 12.09.2016.

No.47251 of 2016 (2) dt.09-12-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VI, Gaya in connection with Tikari P.S. Case No. 265 of 2016.
