2. The petitioner is not named in the F.I.R. and apprehending his arrest in connection with Sarai P.S. Case No. 171 of 2024 registered for the offences punishable under Sections 309(4) of BNS.

3. The allegation against petitioner is to commit robbery along with accused persons where during the course of occurrence cash of Rs. 72875/- along with bio-metric equipments which was in possession of the informant was alleged to be looted.

4. It is submitted by learned counsel appearing on behalf of the petitioner that the name of the petitioner transpired during course of investigation on the basis of apprehended co-accused person. It is submitted by learned

Patna High Court CR. MISC. No.22664 of 2025(2) dt.30-04-2025 2/2 counsel that FIR was lodged after two days of the occurrence. While concluding the argument, it is submitted that petitioner found involved in one more criminal case of different nature, where he is on bail.

Learned APP, while opposing the prayer of bail submitted that investigation of this case is in very initial stage and, therefore, merely on the basis of the fact as name of petitioner transpired on the basis of confessional statement of co-accused, petitioner not appears entitled for anticipatory bail.

6. In view of aforesaid factual submissions and by taking note of fact as investigation of this case is yet to be completed, where petitioner was said to be involved in alleged robbery where cash and bio-metric equipments of informant was looted, accordingly, the prayer of anticipatory bail of the above-named petitioner stands rejected herewith.
