The petitioner is apprehending his arrest in connection with Vaishali P.S. Case No. 247 of 2014 registered under Sections 376, 511 of the Indian Penal Code and 7 & 10 of POCSO Act. Allegation against the petitioner is of attempting to commit rape upon granddaughter of informant.
Submission of learned counsel for the petitioner is that it best as per FIR it is a case under Sections 376/511 IPC. Further submission is that petitioner is neighbour and they have some dispute.
Heard learned APP also.
Having heard both sides and in view of allegation leveled against him, let petitioner surrender before the court below
Patna High Court Cr.Misc. No.37264 of 2017 (2) dt.19-08-2017 2/2 and make prayer for regular bail, which shall be considered on the basis of materials available on record as well as the fact that the parties have settled the dispute and the court below will pass an appropriate order, without being prejudiced by this order. With the above observation, this application is dismissed.
