Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 323, 324, 341, 379, 504, 34 of the Indian Penal Code. It is alleged that in the background of land dispute Md. Arif, own brother of the informant assaulted with sword to the son of the informant and when the informant and his wife came to rescue then brother of the informant Md. Arif, this petitioner being nephew of the informant and mother of this petitioner assaulted with lathi and cheni to the informant and his son.

It is submitted by learned counsel for the petitioner that specific accusation of assault is against the father of this petitioner Md. Arif who has been granted bail vide Cr. Misc. No. 23128 of 2014. The father of the petitioner is

Patna High Court Cr.Misc. No.46536 of 2014 (2) dt.21-04-2015 2/2 alleged to be armed with sword and all the incised injuries of the informant and his son have been found to be grievous whereas the other injuries which are alleged to have been caused by this petitioner have been found to be simple in nature.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kaler P.S. Case No. 15 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
