The petitioner seeks bail in Matihani P. S. Case No. 20 of 2018 instituted for the offence under Section(s) 307, 353 and 354 of the Indian Penal Code and Section 25(A), 26, 27 and 35 of the Arms Act read with Section 17 C.L.A. Act. Petitioner is in custody since 26.6.18.

Learned counsel for petitioner submits that there is no recovery of any arms and ammunition from conscious possession of petitioner.

In the written report it is alleged that two persons, namely Karu Thakur and Nilu Singh have been arrested and arms and ammunition have been recovered from their possession. The name of this petitioner has come in the instant

Patna High Court Cr.Misc. No.71285 of 2018(3) dt.11-12-2018 2/2 case in the confessional statement of co-accused Karu Thakur and Nilu Singh.

It has further been submitted that said Karu Thakur and Nilu Singh have already been granted bail by co-ordinate Bench of this Court by order passed in Cr. Misc. nos. 64306 of 2018 and 38631 of 2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the Fast Track Court 1st Begusarai, in connection with Matihani P. S. Case No. 20 of 2018, Sessions trial no. 514 of 2018,subject to the condition that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) shyambihari/- U T
