Petitioner seeks bail in Ahiyapur P.S. Case No.35 of 2019 instituted for the offence under Section(s) 399, 402, 414, 412 Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act.
It is alleged that police got information that several persons have assembled for committing crime. The police searched the place of occurrence and arrested seven persons and seven persons managed to run away. Petitioner is one of the persons, who was arrested by the police. The police made search of the arrested persons and prepared seizure list. From the seizure list, it appears that different incriminating articles were recovered from possession of Babloo
Patna High Court CR. MISC. No.21179 of 2019(3) dt.30-05-2019 2/2 alias Kallu, Mithun @ Baidhnath Sahani, Saurabh Kumar, Rajan @ Ranjan and Neeraj Kumar. There is no recovery of any incriminating article from possession of the petitioner. Counsel for the petitioner further submits that coaccused, Raushan Kumar, has already been granted regular bail by co-ordinate Bench of this Court by order dated 02.04.2019 passed in Cr. Misc. No.19852 of 2019.
Counsel for the petitioner submits that Petitioner is in custody since 13.01.2019.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur, in connection with Ahiyapur P.S. Case No.35 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
