ANJANA MISHRA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is in custody since 19.10.2016 in connection with Sasaram (Tilauthu) P.S. Case No. 1210 of 2015 registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.
Counsel for the petitioner submits that though he had been earlier granted the privilege of anticipatory bail vide order dated 26.04.2016, however, due to paucity of funds, he could not be able to pay the money, as per the undertaking. Therefore, the order dated 26.04.2016 has been withdrawn vide order dated 14.09.2016, however, giving liberty to the petitioner to surrender in the court below. Accordingly, the petitioner has surrendered in
Patna High Court Cr.Misc. No.49579 of 2016 (2) dt.25-11-2016 the court below. Learned Counsel further submits that a certificate case is pending against the present petitioner and he shall cooperate in the present proceeding and investigation as and when required and further undertakes that he shall present himself in the court below as and when required.
Considering the aforementioned submissions and nature of allegations, let the above named petitioner, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Tilauthu) P.S.
