Petitioner seeks bail in Excise Case No.433 of 2018 arising out of Udakishunganj P.S. Case No.200 of 2018 instituted for the offence under Section(s) 25(1-b)A, 26, 35 of the Arms Act and Sections 37(b)(c) of Bihar Prohibition and Excise Act, 2016.
Counsel for the petitioner submits that one country made pistol and one live cartridge has been recovered from possession of the petitioner.
Petitioner is in custody since 15.07.2018 having clean antecedents.
In the facts and circumstances of the case, prayer of
Patna High Court Cr.Misc. No.74668 of 2018(2) dt.13-12-2018 2/2 the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the ADJ II cum Special Judge, Excise Act, Madhepura, in connection with Excise Case No.433 of 2018 arising out of Udakishunganj P.S. Case No.200 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
