JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 15-12-2015 Heard learned counsel for the petitioners and the State. The petitioners apprehend their arrest in connection with Thakurganj (Kurlikot) P.S. Case No.166 of 2015 registered under sections 406, 409 and 166 of the Indian Penal Code. The petitioner no.2 is son of petitioner no.1. It is alleged that the petitioner misappropriate a sum of Rs.13,000/- deposited by the complainant.

Learned counsel for the petitioner submits that notwithstanding his innocence, he has deposited the said amount in the account of the complainant.

Learned State counsel submits that there is allegation of misappropriation of money of other depositors as well. Having regard to the facts and circumstances of the case, the petitioners, namely, Shiv Kumar Singh and Barun Kumar

Patna High Court Cr.Misc. No.49021 of 2015 (3) dt.15-12-2015 Singh @ Varun Kumar, are directed to be released on anticipatory bail, in the event of their arrest/surrender, on furnishing bail bonds of Rs.7,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in Thakurganj (Kurlikot) P.S. Case No.166 of 2015. One of the sureties would be in form of cash surety. The petitioners would cooperate in the trial.
