JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 406/34 of the Indian Penal Code.

The informant claimed that five to six unknown persons along with petitioner came to his house and asked to deposit some amount in their non banking company.

Subsequently, informant and several other persons deposited the amount with the concerned company but later on, the officials of aforesaid company fled away with deposited amount of informant and others.

No.38830 of 2016 (3) dt.15-11-2016 2/2 of above stated company was got opened in the house of the petitioner by some unknown persons and as a matter of fact, the petitioner has been roped in this case only on the ground that he had given his house on rent to those persons. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Manish Pandey, Judicial Magistrate 1st Class, Muzaffarpur in connection with Kurhani P.S.
