The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 120(b), 124(A) of the Indian Penal Code, 25(1-b)A, 26, 35 of the Arms Act, 17 of C.L.A. Act and 2, 4 and 5 of Explosive Substance Act.

The prosecution case in short is that on a search made by the informant, several incriminating articles and explosives were recovered from the accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.2.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge IX, Aurangabad in connection with S. Tr. No. 298/18/41/19 arising out of Deo P.S. Case No. 78/15.
