The petitioner seeks anticipatory bail in Akbarpur P.S. Case No.40 of 2017 instituted for the offences under Sections 30(a) of the Bihar Prohibition and excise Act, 2017. It has been alleged that 10 liters of counter made liquor has been recovered from the house of the petitioner. In such view of the matter, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly the prayer for bail is rejected. However, if the petitioner surrenders before the court below within a period of three weeks, the court below will pass an order on the same day on its own merit without being prejudiced by the order passed by this Court.
