The petitioner seeks bail in Chandauti P.S. Case No. 117 of 2018 instituted for the offence under Sections 392, 387, 341, 342, 435 and 120(B) of the Indian Penal Code. Counsel for the petitioner submits that petitioner is not named in the written report. No Test Identification Parade has been held. No incriminating article has been recovered from his possession. His name has come in the confessional statement of co-accused Pramod Yadav.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like

Patna High Court Cr.Misc. No.76995 of 2018(2) dt.20-12-2018 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Chandauti P.S. Case No. 117 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
