JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Sheohar P.S. Case No. 24 of 2019, disclosing offences under Sections 341, 323, 379, 325, 427, 452 and 308/34 of the Indian Penal Code.

Allegation against the petitioners is that he has entered into the house of the informant with arms and ammunition and assaulted the family members of the informant and taken away the licensee broken gun and also taken away the golden chain worth Rs.30,000/-. Further allegation of assault against the informant, causing injury.

No.20928 of 2019(3) dt.19-06-2019 2/2 Submission of the learned counsel for the petitioners is that the falsity of the case would appear from the fact that broken gun was recovered from the police station itself and there is dispute between the parties as there was complaint against the informant at the instance of the complainant against the informant and by the accused persons and due to that present case has been lodged against the petitioners. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Sheohar, in connection with Sheohar P.S. Case No. 24 of 2019 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
