2. The petitioner seeks bail in connection with Garkha P.S. Case No. 721 of 2024 dated 23.11.2024, instituted for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352 of the B.N.S., 2023.

The prosecution case, in short, is that on 15.11.2024, the petitioner came to the field of informant and demanded Rs. 10000/- upon which the informant told him that he did not brought money at the field then the petitioner started abusing him. When the informant protested then the petitioner took out a knife and gave a knife blow on the chest of informant due to which he sustained injury. It is also alleged that petitioner snatched gold chain from the neck of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that petitioner and informant are full brothers. The occurrence took place on 15.11.2024 on account of some pity dispute. It is also submitted that petitioner also got injured in the said scuffle between the parties. It is next submitted that although the injury received by the informant is grievous in nature but there is no allegation of repeated blow. It is further submitted that Ramlayak Rai (father of informant and petitioner) has six sons. Informant, Jitendra Ray and Indradev Ray have grabbed the entire share of the petitioner and they are also being supported by their father, however, Upendra Ray (brother of informant and petitioner) and his family support the petitioner. There is property dispute between the petitioner and his two brothers and father. Lastly, it has been submitted that the petitioner is in custody since 12.01.2025, he has one criminal case against him and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let
Patna High Court CR. MISC. No.22656 of 2025(4) dt.23-07-2025 3/3 the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Saran, Chapra in Garkha P.S. Case No. 721 of 2024.
